| Customs & Taxation Customs Regulations of the People's Republic of China of the Control of Luggage and Articles Carried by Chinese Passengers Entering and Leaving the Border
Article 2 This set of regulations applies to those passengers entering and leaving the border with passports of the People's Republic of China or other valid traveling credentials, including those Chinese residents who are either sent abroad by the state to work, make and on-the-spot investigation, to pay a visit and to study or those who go abroad for private reasons such as visiting their relatives or friends, traveling, doing business and studying as well as the non-resident Chinese passengers, such as overseas Chinese, and compatriots form Taiwan, Hong Kong and Macao. Article 3 In case the Chinese passengers carry into the border luggage that belong to the varieties and within the quantity limits stipulated in the Table of Restricted Quantities for Articles to be Carried into the Country by Chinese Passengers attached to these Regulations as an appendix(hereinafter referred to as "the Table of Restricted Quantities", see Appendix 1),the Customs shall give clearance after examining the valid entry-exit documents of certification and other approving documents. Luggage under item 1,as listed in the Table of Restricted Quantities, carried by passengers who are under the age of 16,shall be limited as their traveling necessities and released by the Customs. Article 4 Luggage carried by entering Chinese passengers, beyond the restricted quantity of dutyfree articles but still belonging to articles for personal use, shall be released with duty payment after being verified and approved by the Customs. Article 5 Articles for personal use carried by Chinese passengers entering and leaving the border shall be released in accordance with Customs Provisions of the People's Republic of China on the Control over the Articles for Personal Use Carried by Passengers Entering and Leaving the Border. Article 6 Chinese non-resident passengers, who obtain the permission to settle down in the country, shall submit a single application to the competent Customs at the place of their residence with the settlement certification issued by the relevant authority of the People's Republic of China when they bring into the border the articles and cars for personal use, owned and used by them abroad, within 3 months after they are permitted to settle down in the country. Where the aforesaid articles or personal use are within reasonable quantities, except for those with duty-payment under the List of Dutiable Articles for Personal Use and Establishment Carried by Passengers Intending to Settle Down in the Country(see Appendix 2),the Customs shall give clearance duty-free after examination and verification. As for articles, the duty-paying value of which are above RMB 1,000 yuan and below RMB 5,000 yuan(RMB 5,000 yuan included),one is limited for each category. As for personal cars and motorcycles, one for each household shall be brought into the border, and duties and taxes shall, according to relevant regulations, be levied by the Customs. Articles and cars for personal use, which are permitted to enter the border, shall be shipped to the designated port within 6 months of the approval by the Customs. Customs formalities for the motorvehicles shall be completed by the Customs establishment at the place where the articles are brought into the territory against the approval documents issued by the competent Customs at the place of their residence and the import declarations filled out by the passengers. Article 7 If the passengers who reside in China for less than two years as from the date of his entry and intend to re-settle down abroad, the duty-free articles for personal use carried by them at the time of entry shall be re-shipped out of the territory or Customs duties shall be paid according to the Rules of the Customs of the People's Republic of China Concerning the Levying of Import Duties on Luggages and Articles of Passengers Entering the Border and Personal Postal Articles. In case articles for personal use are brought into the country by passengers, who resettle down abroad and remain there for less than two years, and who intend to settle down again in China, the Customs shall handle the case in accordance with Article 3 of these Regulations. Article 8 If Chinese non-resident passengers intend to work or study on a long-term basis within the territory, but have not received the certification of long-term residence yet, luggage and articles carried by them at time of entry and exit shall be released after Customs examination according to these Regulations. If they have received the certification of long term residence, the case shall be handled in accordance with the Customs regulations governing the inward and outward articles for public and personal use carried by nonresident passengers residing on a long-term basis and resident offices. Article 9 With respect to the passengers having multiple entry-exit between Hong Kong/Macao and the inland area in short time, personnel entering and leaving the country on a regular basis and border residents, the Customs only release the articles for daily use needed on the journey, Specific regulations shall be formulated separately the authorized Customs office and be promulgated and put into effect after approval by the Customs General Administration of the People's Republic of China. In the preceding paragraph, "multiple entry-exit in a short time" and entering and leaving the country on a regular basis" refer to entering or leaving the territory more than once in fifteen(15)days. Article 10 Except for the articles, prohibited and restricted by the state from leaving the border which shall be handled according to relevant regulations, where the luggage and articles carried by Chinese passengers leaving the country are within reasonable quantities, the Customs shall give clearance after examination and verification. As for luggage and articles to be shipped out of the border separately, the owners shall go through customs formalities at the place of their residence against their valid certification of exit before leaving the border. Article 11 The luggage and articles carried by Chinese passengers entering and leaving the border beyond the reasonable quantities for personal use, restricted quantity, value or variety as stipulated, shall not be released by the Customs, except as otherwise provided. Except for those declared to be abandoned by the owner, articles not permitted in shall be taken back with related Customs formalities by the owner or his/her agents within 3 months. Those who do not complete with the above-mentioned formalities within the prescribed time-limit shall be dealt with in accordance with Article 33 of the Customs Law of the People's Republic of China. Article 12 Passengers entering and leaving the border shall comply with these Regulations and other supplementary regulations concerning the implementation of these Regulations promulgated by the relevant Customs authorized by the Customs General Administration of the People's Republic of China. Violations of the present Regulations shall be dealt with by the Customs in accordance with the Customs Law of the People's Republic of China and the Detailed Rules for the Implementation of Administrative Discipline of the Customs Law of he People's Republic of China. Article 13 The right to interpret these Regulations shall reside in the Customs General Administration of the People's Republic of China. Article 14 These Regulations shall come into effect as of August 15,1996.
